PART A: GENERAL TERMS AND CONDITIONS

1. Application and Access

This website is operated by Carina Day & Night Pharmacy (ABN 57 631 737 009) (“we”, “us”, “our”). These Terms of Service (Terms) apply when you use our website at https://shop.carinapharmacy.com.au, including all information, tools, products and services available on it. Our Privacy Policy, available at https://shop.carinapharmacy.com.au/policies/privacy-policy, forms part of these Terms.

By using the Website you agree to be bound by these Terms. You confirm that you have the authority to act on behalf of any entity for whom you are accessing the Website. If you do not agree, you must refrain from using the Website. We may update these Terms at any time by updating this page, and your continued use of the Website constitutes acceptance of the updated Terms.

If you purchase products via the Website, the Product Purchase Terms in Part B also apply.

 

2. Your Obligations

You must not:

 

       copy, mirror, reproduce, translate, adapt, vary, modify, sell, decipher or decompile any part or aspect of the Website without our express written consent;

       use the Website for any purpose other than obtaining information about us and our products, or purchasing products via the Website;

       use, or attempt to use, the Website in a manner that is illegal or fraudulent or facilitates illegal or fraudulent activity;

       use a false email address, pretend to be someone other than yourself, or otherwise mislead us;

       use, or attempt to use, the Website in a manner that may interfere with, disrupt or create undue burden on the Website or the servers or networks that host the Website;

       use the Website with the assistance of any automated scripting tool or software;

       act in a way that may diminish or adversely impact our reputation, including by linking to the Website on any other website; or

       attempt to breach the security of the Website, or otherwise interfere with the normal functions of the Website, including by:

gaining unauthorised access to Website accounts or data;

scanning, probing or testing the Website for security vulnerabilities;

overloading, flooding, mail-bombing, crashing or submitting a virus to the Website; or

instigating or participating in a denial-of-service attack against the Website.

If you create an account, you are responsible for keeping your credentials confidential and for all activity under your account. You must provide accurate information and notify us immediately of any suspected unauthorised access. We may disable any account that we reasonably believe has been used in breach of these Terms.

Information on this Website is general in nature and does not constitute medical or health advice. It should not be relied upon as a substitute for consultation with a qualified health professional. If you have questions about a product’s suitability for your circumstances, please speak to a pharmacist or your prescribing practitioner before purchasing.

To the maximum extent permitted by law, we do not warrant that the Website will be error-free, uninterrupted, or secure, or that any information on it is accurate or current. We may update or remove Website content at any time without notice.

All Website content (including text, graphics, logos, images and software) is our intellectual property or that of our licensors. You may view and use Website content only for the purpose of using our Services and purchasing our products.

 

5. Limitation of Liability

The Website is provided ‘as is’ and ‘as available.’ To the maximum extent permitted by law, we are not liable for any loss or damage (whether direct, indirect, consequential or otherwise) arising from your use of or inability to access the Website. You agree to indemnify us against any loss arising from your unauthorised or unlawful use of the Website.

Nothing in this clause limits your rights under the Australian Consumer Law or any remedy available to you under the Product Purchase Terms in Part B.

 

6. General

These Terms are governed by the laws of Queensland. Any dispute arising under these Terms will be subject to the exclusive jurisdiction of the Queensland courts.

If any provision of these Terms is unenforceable, it will be severed and the remaining provisions will continue in full force. Any delay or forbearance on our part in enforcing any term or condition of these Terms will not be deemed a waiver of our rights under these Terms. These Terms constitute the entire agreement between you and us regarding use of the Website.

PART B: PRODUCT PURCHASE TERMS

7. Right to Refuse Sale and Customer Eligibility

We reserve the right to refuse to supply any product at our absolute discretion, including where supply may constitute a health hazard, where quantities appear excessive, or where a product has known abuse potential.

By placing an order, you confirm that you are 18 years of age or older (or a parent or legal guardian ordering on behalf of a minor patient with a valid prescription). We may request proof of age or identity at any time.

 

8. Prescription Products

Certain products require a valid prescription issued by a registered Australian medical practitioner. By purchasing a prescription product, you confirm that:

 

       you hold a current, valid prescription issued in your name by an AHPRA-registered practitioner;

       you are the person named on the prescription; and

       all information you provide in connection with your prescription is accurate and complete.

 

We reserve the right to verify your prescription with your prescribing practitioner and to refuse supply if we are unable to do so, or if the prescription is found to be invalid or expired. Prescription products cannot be returned or exchanged once dispensed except as required by law or as set out in our Returns and Exchanges Policy.

 

9. Ordering and Payment

To place an order, add your chosen product to your cart and proceed to checkout. We accept the following payment methods:  . Processing fees may apply. You will receive an email confirmation once your order is placed and a further notification once it has been dispatched.

 

10. Shipping and Delivery

Shipping is available nationwide in Australia to physical addresses only. Click & Collect is available for local orders for next working day pickup. All orders are dispatched via our nominated courier.

Our estimated delivery timeframe of 1–5 working days runs from the date of courier collection, not from the time of order placement. Once dispatched, delivery times are subject to the courier’s operations. While we cannot guarantee delivery times, we will make reasonable efforts to assist you in following up on any delays.

11. Returns, Exchanges and Damaged Goods

Our full returns process is set out in our Returns and Exchanges Policy at https://shop.carinapharmacy.com.au/policies/refund-policy. Key terms are:

 

       Prescription products cannot be returned or exchanged once dispensed, except where required by law, a product was damaged in transit, or the wrong product was supplied.

       Non-prescription products may be returned within 30 days if unopened and in original condition, subject to eligibility. Change-of-mind returns and exchanges are at our discretion. Return shipping is at your expense.

       Products marked non-returnable on the product page cannot be returned except in the case of transit damage, incorrect supply, or as required by law.

 

If your order arrives damaged, retain all packaging and contact us within 48 hours with photographic evidence. Notify us of any lost or incomplete deliveries within 10 days of the expected delivery date. We reserve the right to assess returned products before approving any remedy.

 

12. Australian Consumer Law

Our products come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms limits your statutory consumer rights. Any product that is faulty, damaged, or not fit for purpose may be returned for a remedy in accordance with the Australian Consumer Law. Where a refund is approved, we will endeavour to process it within 7 working days.
